These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "Company Administrator", or "User") and CybroCompany (Aman Kumar), operating under the brand name Wolkiro ("we", "us", "our"). By creating an account or using the Wolkiro platform, you agree to these Terms in full.

1. The Service

Wolkiro is a subscription-based, multi-tenant B2B workforce management platform that provides GPS geofenced attendance tracking, employee management, site supervision tools, and automated subscription billing. The platform consists of a web-based administration dashboard and an employee-facing mobile application.

2. Account Registration and Eligibility

• You must be at least 18 years of age and have the legal authority to enter into this agreement on behalf of your organisation.
• You agree to provide accurate, complete, and current information during registration.
• One organisation may only maintain one active account unless explicitly approved by us.

3. Account Security and Responsibility

As a company administrator, you are entirely responsible for maintaining the security of your account credentials, API keys, and employee PIN codes. You must:

• Keep your login credentials confidential and not share them with unauthorised parties.
• Immediately notify us at support@wolkiro.com if you suspect any unauthorised access to your account.
• Ensure that employee PINs are distributed securely and only to the intended employees.

We are not liable for any loss or damage arising from your failure to maintain the security of your account.

4. Subscription, Billing and Payment

• The platform is offered on a per-employee-per-month basis at ₹49 per active employee + 18% GST.
• A 14-day free trial is provided upon registration, with no credit card required.
• Invoices are auto-generated at the start of each billing cycle and delivered with a Razorpay payment link.
• A 7-day grace period is provided from invoice generation to make payment.
• Accounts overdue by more than 14 days may be automatically suspended.
• All payments are processed securely by Razorpay. We do not store card details.

5. Cancellation and Refunds

Cancellation and refund terms are governed by our Cancellation & Refund Policy, which forms an integral part of these Terms.

6. Acceptable Use

You agree not to:

• Use the platform in any manner that is unlawful, fraudulent, or harmful.
• Attempt to reverse-engineer, decompile, or extract source code from the platform.
• Use automated tools to scrape, crawl, or excessively query the platform's API.
• Upload any content that is defamatory, obscene, or infringes on third-party intellectual property.
• Use the platform to track individuals without their knowledge or consent.

7. Employer Responsibility

As the company administrator, you are responsible for ensuring that the collection of employee location data and photographs is compliant with applicable Indian labour laws and that employees have been informed of and consented to such monitoring as a condition of their employment.

8. Service Availability and Limitations

We strive to ensure 99.9% uptime for the Wolkiro platform. However, we are not liable for any service interruptions, downtime, or data unavailability caused by:

• Third-party cloud hosting providers (including AWS) or network outages.
• Force majeure events including but not limited to natural disasters, governmental actions, or cyber-attacks.
• Scheduled maintenance, which we will endeavour to announce in advance.

9. Intellectual Property

All software, design, code, trademarks, and content within the Wolkiro platform are the exclusive property of Aman Kumar / Wolkiro (CybroCompany). You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose during your active subscription.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Wolkiro shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the platform.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar, India.

12. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify company administrators of material changes via email at least 14 days before they take effect. Continued use of the platform after changes constitutes acceptance of the updated Terms.
